Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Prometheus Games LLC ("Prometheus Games", "we", "our", "us"), a US-based game studio. By accessing prometheusgames.io or downloading, installing, or playing any of our games (including A Final Frontier), you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.

You must be at least 13 years old (or the minimum age required in your country) to use our services. If you are a minor in your jurisdiction, you must have permission from a parent or legal guardian to use our services and to accept these Terms on your behalf.

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use our websites and games for personal, non-commercial entertainment purposes. All rights not expressly granted are reserved.

Some features may require an account or platform login (e.g., Apple ID). You are responsible for activity that occurs under your account and for keeping your credentials confidential. Notify us promptly of any suspected unauthorized use.

You agree not to: (a) violate any applicable law; (b) cheat, exploit bugs, use unauthorized third-party tools, bots, or modifications; (c) reverse engineer, decompile, or attempt to extract source code except where permitted by law; (d) interfere with or disrupt the services or servers; (e) harass, threaten, or harm other players; (f) infringe intellectual property or privacy rights; or (g) attempt to access accounts, data, or systems that are not yours.

Our games may offer virtual items, currency, or content available for purchase or earned in-game. Virtual items have no monetary value, are licensed (not sold) to you, are non-transferable, and are non-refundable except as required by law or the rules of the platform from which you purchased them (e.g., the Apple Media Services Terms). We may modify, suspend, or remove virtual items at any time for balancing, technical, or legal reasons.

If you submit feedback, suggestions, or other content to us, you grant Prometheus Games a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and incorporate that content into our products without obligation to you. You represent that you have all necessary rights to grant this license.

All content, software, art, music, code, characters, names, trademarks, and logos associated with Prometheus Games and our games — including "Prometheus Games" and "A Final Frontier" — are owned by Prometheus Games LLC or its licensors and are protected by US and international law. Nothing in these Terms transfers ownership to you.

Our games are distributed through third-party platforms (such as the Apple App Store). Your use of those platforms is also subject to their separate terms. We are not responsible for third-party services, websites, or platforms linked to or integrated with our products.

Because we are players first, we actively maintain, patch, and balance our games. We may add, modify, suspend, or discontinue features, content, or entire services at any time, with or without notice. We are not liable for any loss of progress, virtual items, or availability resulting from such changes, except as required by law.

We may suspend or terminate your access to our services at any time for any reason, including violation of these Terms. You may stop using our services at any time. Sections that by their nature should survive termination will survive.

Our services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, Prometheus Games LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the services. Our total aggregate liability for any claim arising out of or relating to the services will not exceed the greater of US $50 or the amount you paid us in the twelve months preceding the claim.

You agree to defend, indemnify, and hold harmless Prometheus Games LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the services, your User Content, or your violation of these Terms.

These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict-of-laws principles. The parties consent to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute not subject to arbitration, except where prohibited by your local consumer protection laws.

We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
